Welcome to homexpo.in (“Website”). These Terms of Use (“Terms”) form a binding agreement between HomeXpo Proptech (“HomeXpo”, “we”, “us”, “our”) and you (“you”, “user”). By accessing or using the Website, creating an account, listing a property/project, submitting an inquiry, or making any payment on or through the Website, you agree to these Terms and to our Privacy Policy and Cookie Policy (collectively, the “Policies”). If you do not agree, please do not use the Website.

Note on role: HomeXpo is a RERA-registered real estate agent
(A) an online information and discovery platform/marketplace for real-estate projects and listings, not a developer, builder, or owner; or
(B) a RERA-registered real-estate agent/brokerage (Registration No.: A031332400005), acting as an intermediary between buyers/tenants and developers/owners.

1) Eligibility & Account

  1. You must be 18+ and legally capable of entering into contracts under Indian law.
  2. You are responsible for your account credentials and all activities under your account. Notify us immediately of any unauthorized use.
  3. We may refuse, suspend, or terminate access if you violate these Terms or applicable law.

2) Website & Service Description

  1. The Website provides information, tools, and services for property discovery, comparisons, inquiries, site visits, lead sharing, and—where applicable—booking tokens or service fees (“Services”).
  2. Third-party information: Many listings, project details, floor plans, brochures, RERA numbers, pricing, availability, timelines, and offers are provided by developers/agents/owners (“Third-Party Providers”). Such information may be indicative, subject to approvals, and may change without notice.
  3. No professional advice: Information on the Website is for general information only and does not constitute legal, financial, investment, or tax advice. Please consult qualified advisors before making decisions.

3) RERA Disclosures & Property Disclaimers

  1. RERA compliance: For under-construction or ongoing projects, users should verify the RERA registration number, approvals, sanctioned plans, carpet area, completion timelines, and other disclosures on the state RERA portal.
  2. Representations: Images may be artistic impressions or sample flats and may include upgrades. Amenities, specifications, layouts, and prices are subject to change by the developer/owner per applicable laws.
  3. Due diligence: You are solely responsible for conducting independent due diligence, site inspections, legal title checks, and verifying encumbrances, approvals, and regulatory status.
  4. If HomExpo acts as a RERA-registered agent, we will display our registration number and comply with relevant obligations; however, we do not guarantee project completion, quality, or returns.

4) User Obligations

  1. You agree to use the Website lawfully and not to:
    • upload or transmit false, misleading, defamatory, obscene, infringing, or unlawful content;
    • scrape, spider, crawl, index, or mirror the Website without written consent;
    • circumvent security features or interfere with servers or networks;
    • post listings without authority or that violate third-party rights or law;
    • misrepresent your identity, ownership, RERA status, or approvals.
  2. Advertisers/Developers/Agents/Owners must ensure that all property information is accurate, up-to-date, and compliant with RERA and other laws and must promptly correct any inaccuracies.
  3. If you are an agent/agency, you must display your RERA registration number and comply with advertising norms in your jurisdiction.

5) Listings, Leads & Communications

  1. By submitting a lead, inquiry, callback request, or site-visit request, you consent to being contacted by HomeXpo and/or the relevant Third-Party Provider via phone, WhatsApp, SMS, email, or in-app notifications, including via automated systems.
  2. Lead sharing: With your consent (express or implied via an inquiry or action on a listing), your contact details and preferences may be shared with the relevant Third-Party Provider to service your request.
  3. HomExpo may moderate or remove content/listings at its discretion (e.g., suspected fraud, non-compliance, or user safety concerns).

6) Payments, Fees & Refunds

  1. Certain Services may be fee-based (e.g., featured listings, booking tokens, convenience fees). Fees, if any, will be displayed before payment.
  2. Payments are processed by third-party payment gateways; HomExpo does not store full card details.
  3. Booking tokens & refunds: If you pay a token or booking amount via the Website, the terms of refund, cancellation, and forfeiture are as per the specific offer/developer/owner. HomExpo’s role (if any) is limited to facilitating the transaction.
  4. Please also review our Refund & Cancellation Policy for platform-level fees (if applicable).

7) Intellectual Property

  1. The Website, including text, interfaces, graphics, logos, icons, images, design, compilations, and software, is protected by the Copyright Act, 1957 and other applicable laws.
  2. You may use the Website for personal, non-commercial purposes. Any reproduction, modification, distribution, reverse engineering, or derivative works require prior written consent.
  3. User Content: By posting or uploading content (e.g., descriptions, photos, floor plans, brochures, logos), you grant HomExpo a non-exclusive, worldwide, royalty-free licence to use, host, reproduce, modify (for formatting), display, and distribute such content for providing and promoting the Services. You represent you have the necessary rights to grant this licence.

8) Privacy, Cookies & Data Protection

Your use of the Website is also governed by our Privacy Policy and Cookie Policy, which explain what data we collect and how we use it, consistent with applicable Indian laws (including the Digital Personal Data Protection Act, 2023, IT Act, and SPDI Rules).


9) Third-Party Services & Links

The Website may contain links to third-party sites, tools, payment gateways, maps, messaging widgets, and embedded content. We do not control or endorse third-party services and are not responsible for their content, terms, or policies. Your use of third-party services is at your own risk.


10) Disclaimer of Warranties

The Website and Services are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, HomExpo disclaims all warranties, express or implied, including non-infringement, merchantability, and fitness for a particular purpose. We do not warrant that:

  • the information is accurate, complete, current, or error-free;
  • the Website will be uninterrupted, secure, or free of viruses;
  • outcomes from using the Services will meet your expectations.

11) Limitation of Liability

To the maximum extent permitted by law, HomExpo shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, goodwill, or opportunity, arising from or related to your use of the Website/Services, even if advised of the possibility. Our aggregate liability for all claims in connection with the Website/Services shall not exceed the greater of INR 5,000 or the total fees paid by you to HomeXpo in the 3 months preceding the claim (excluding amounts paid to developers/owners).


12) Indemnity

You agree to indemnify, defend, and hold harmless HomeXpo, its directors, officers, employees, and affiliates from any claims, damages, losses, liabilities, costs, and expenses (including legal fees) arising out of or related to: (i) your use of the Website/Services; (ii) your content or listings; (iii) your breach of these Terms or law; or (iv) infringement of third-party rights.


13) Takedown, Complaints & Grievance Redressal

  1. We follow reasonable notice-and-takedown procedures. If you believe any content violates law or your rights, please write to our Grievance Officer with details and supporting documents.
  2. We will review and take appropriate action consistent with applicable laws, including the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021.

14) Termination & Suspension

We may suspend or terminate your access for any violation of these Terms, suspected fraud, non-payment of fees, legal or security reasons, or discontinuation of the Services. You may stop using the Website at any time. Certain provisions (e.g., IP, disclaimers, limitation of liability, indemnity) survive termination.


15) Changes to the Website & Terms

We may modify, suspend, or discontinue any part of the Website/Services at any time. We may update these Terms periodically. The “Last updated” date reflects the latest revision. Continued use after changes signifies your acceptance of the revised Terms.


16) Governing Law & Dispute Resolution

These Terms are governed by the laws of India. Subject to the arbitration clause below, the courts at Thane, Maharastra shall have exclusive jurisdiction.

Arbitration: Any dispute shall be finally resolved by arbitration in accordance with the Arbitration and Conciliation Act, 1996, by a sole arbitrator appointed by HomeXpo and you jointly, seated in Thane, with proceedings in English. The award shall be final and binding.


17) Miscellaneous

  • Entire agreement: These Terms, together with the Policies, form the entire agreement between you and HomeXpo.
  • No waiver: Failure to enforce any provision is not a waiver.
  • Severability: If any provision is held invalid, the remainder remains enforceable.
  • Assignment: You may not assign these Terms without our prior written consent; we may assign to an affiliate or in connection with a merger/transfer.
  • Electronic communications: You consent to receive communications electronically (email, SMS, WhatsApp, in-product notices).
